EARF, through its platforms Earf.TV (formerly known as Interactive.Earth), provides an online service accessible via earf.tv and related subdomains including Interactive.Earth, RemoteVehicleEstimating.com.au and EARFguess (guess.earf.tv). The Privacy Policy (“Privacy Policy”) are a legal agreement between you (the User) and EARF governing your access to and use of our websites and services. By accessing or using Earf.TV or any associated site, you confirm that you have read, understood, and agree to be bound by the Privacy Policy.

1. Information We Collect

EARF collects limited personal information for user accounts, such as name, username, email, country, and password. This data is used solely for account creation, management, and security purposes. Additionally, we use third-party analytics services to gather aggregated, non-personal data to monitor platform performance and improve user experience.

Additionally, we store users' acceptance of the Terms of Service, Privacy Policy, and DMCA & Copyright Disclaimer for compliance purposes. This data is securely stored and used only for legal and administrative purposes.

Earf does not collect or store personally identifiable user data. We do not require user accounts, and we do not track individual users. However, we do use third-party services (such as Google Analytics) to understand platform usage and improve our services.

IP, User Agent, and Device Fingerprint Ban Check: When you visit Earf.TV, your public IP address, user agent, and device fingerprint are automatically checked against our internal ban database as part of our security and anti-abuse (FAFO) system. These identifiers are not stored unless they match a banned or flagged entry, in which case they are logged for enforcement and security review. This process helps protect the platform and users from abuse and is not used for profiling or marketing.

Additionally, Earf detects a user's timezone on page load to determine if compliance popups related to GDPR (EU), CPRA (California), and LGPD (Brazil) should be shown. This ensures users receive the correct data protection disclosures based on their location.

These analytics and compliance tracking mechanisms may collect non-personal data, including:

  • Aggregated user behavior data (e.g., most viewed streams or pages)
  • Device type and browser information
  • General location data inferred from timezone settings (e.g. country-level location, not precise GPS coordinates)

Earf does not track or retain individual user sessions, login details, or any personally identifiable information. We have but do not require user accounts, and we do not share or sell personal data with third parties.

2. How We Use Your Information

The personal information collected for user accounts is used to:

  • Create and manage your account
  • Provide access to personalized features, such as saving favourites
  • Ensure compliance with legal requirements

Other data collected by Earf is via third-party analytics services. We use this data to:

  • Monitor platform performance and uptime
  • Understand aggregated usage trends
  • Improve the user experience based on anonymous, aggregate information.

Earf does not collect, store, or track personal user information beyond these anonymous analytics. If our data collection practices ever change to include personal information, we will update this Privacy Policy and notify users in advance.

3. How We Protect Your Information

We employ robust SSL encryption and secure databases to ensure the safety and security of your data.

4. Cookies and Tracking Technologies

Earf uses local storage and session storage to enhance your experience by remembering certain preferences, such as:

  • Whether you have already responded to compliance popups (e.g. GDPR, CPRA, LGPD notices).
  • Basic site preferences that improve usability (for example, your selected language or other interface settings).
  • Temporary technical/session data for features (such as stream selections or session continuity), and for security features (such as tracking FAFO triggers or temporary ban status).

What we store: We may store non-personal, technical, or preference-related data in your browser's localStorage and sessionStorage. This can include things like your theme choice, last viewed stream, compliance popup status, temporary tokens for session continuity, and security-related flags (e.g. FAFO triggers or temporary ban status). This data is only accessible by your browser and our site scripts, and is not used for advertising or profiling.

Third-party storage: Third-party services integrated into Earf.TV (such as Google Analytics, YouTube embeds, or Google AdSense) may also use cookies, localStorage, or sessionStorage to store their own data on your device. This can include analytics identifiers, ad preferences, or video playback settings. These third parties manage their own storage and data according to their respective privacy policies.

We do NOT use cookies or local storage for tracking individual users, advertising, or storing personal information. You can manage your local storage and cookies through your browser settings.

We do not use cookies or local storage to track individual users, to serve targeted advertising, or to store personal information. All local storage usage is solely to improve site functionality for you. You can manage or clear your local storage and cookies at any time through your browser settings.

Note: If you block or clear localStorage, sessionStorage, or cookies, some features of the site may not function as intended, or may function better if things are not working correctly—especially after a platform update.

5. Use of Device and Location Data

In cases where we do request or process information that can pinpoint an end user’s precise geographic location (for example, through GPS on a mobile device, Wi-Fi triangulation, or cell tower data), we take utmost care and transparency in our practices:

  • We will explicitly notify users (via a pop-up or just-in-time notice) about the purpose for collecting precise location data (such as providing location-specific features or alerts). We will also clarify that the data may be shared in an encrypted form with specific partners (for example, mapping or analytics services like Mapbox or Google).
  • We obtain your express opt-in consent before collecting, using, or disclosing any precise geolocation information. This consent will cover the transmission of location data to our partners (like Mapbox or Google) in encrypted form.
  • Once your precise location information is transmitted securely and in encrypted form to the necessary third-party service, we do not retain or store that information on our servers. Our involvement ends once the data is securely passed to the service (e.g. for map rendering or relevant content), and we do not track or log your precise location ourselves.
  • We ensure that any transmission of sensitive location data to third parties occurs over secure, encrypted channels. We maintain the encrypted state of such data throughout the process to prevent any unauthorized access during transit.
  • We provide comprehensive disclosure within all pertinent privacy policies, affirming that this information collection, processing, or disclosure does not involve tracking or retention on our end. Users can trust that their location data, once securely transmitted for specific purposes, is not stored or monitored by our systems.

6. Data Sharing and Disclosure

We provide clear disclosures (such as in this Privacy Policy and any in-app permission requests) to affirm that collection or use of precise location data is strictly opt-in and is not stored or tracked by Earf. You can trust that once your location data is used for the immediate purpose (with your consent), it is not retained by us.

7. Cloudflare

We utilize Cloudflare to enhance the security, performance, and reliability of our platform. Cloudflare provides services such as a content delivery network (CDN), DDoS protection, and web application firewall (WAF) to ensure uninterrupted access to our website.

As part of its operations, Cloudflare may collect limited technical information about your visit, including your IP address, system configuration details, and other traffic-related data. This information is processed solely to improve service functionality, detect and mitigate malicious activity, and optimize content delivery.

Occasionally, we may enable specific Cloudflare features, including Bot Fight Mode, Web Analytics, or geolocation headers. These features are used to enhance security, monitor aggregated platform usage, and ensure compliance with regional regulations. For example:

  • Bot Fight Mode: Detects and mitigates automated malicious activity, such as bots attempting to abuse the platform.
  • Web Analytics: Provides aggregated, non-personal insights into platform performance and user behavior.
  • Geolocation Headers: Infers general location data (e.g., country-level) to optimize content delivery or display compliance notices based on applicable laws.

These features process non-personal data and are used exclusively for operational purposes. Cloudflare does not use this data for advertising or profiling. All data collected by Cloudflare is handled in accordance with their privacy practices.

Cloudflare acts as a data processor and complies with GDPR and other relevant privacy regulations. For more information about how Cloudflare handles data, please refer to their Privacy Policy.

We also use certain trusted third-party services to enhance our platform’s functionality. These include services like Google Analytics, the YouTube API, and Google AdSense,. These third-party services may process limited user data (such as general browsing behavior or interactions with embedded content), but always in accordance with their own privacy policies and applicable laws. We only integrate with third parties that commit to strong data protection standards.

Any third-party service providers we use are required to handle data securely and confidentially. We have agreements or terms in place with such providers to ensure that any data they process on our behalf is protected and used only for the intended purpose.

8. Google Analytics

We utilize Google Analytics, a web analytics service provided by Google, Inc., to help us understand how users engage with our Website. Google Analytics uses cookies (small text files stored on your device) to generate statistical information about your use of Earf.TV (and related sites like Interactive.Earth).

The information generated by these cookies about your use of our sites (including possibly your IP address, which can indicate your general geographic area) may be transmitted to and stored on Google servers in the United States. Google uses this information to evaluate your use of the website, compile reports on website activity for us, and provide other services related to website traffic and internet usage.

Google may also transfer this analytics information to other parties if required by law, or where those parties process the information on Google’s behalf. By using Earf’s sites, you consent to the processing of data about your usage by Google as described above.

Google also offers a browser add-on if you wish to opt out of Google Analytics tracking.

9. YouTube API

Earf utilizes the YouTube Data API to integrate YouTube video content and related services into our platform. By using features on Earf that involve YouTube content, you are also agreeing to be bound by the YouTube Terms of Service.

Through the YouTube API, Earf may collect and process certain data from YouTube or about how you interact with YouTube videos on our site, including:

  • YouTube video IDs and associated metadata (such as titles, Thumbnails, descriptions, and other Channel information of videos).
  • Your interactions with embedded YouTube videos (for example, play/pause events, likes/dislikes, etc.).
  • Real-time information on live video view counts.
  • Thumbnails and other video details provided via the API.
  • Technical data like your IP address and device information when you watch an embedded YouTube video (this is collected by YouTube’s player).

We use information obtained via the YouTube API to display and enhance video content on Earf (for example, showing video details or counting views) and to understand user engagement with that content in aggregate. This helps us improve our offerings (such as which videos or streams are most popular).

We adhere strictly to the YouTube API Services Terms of Service and Google’s Privacy Policy when using this data. We do not store any personal information about your YouTube account (in fact, you generally do not need to log in to YouTube via our site). If at any point you wish to revoke Earf’s access to data permissible through the YouTube API, you can do so via the Google Security Settings page.

10. Google AdSense

Earf may use Google AdSense to display advertisements on some pages of our platform. Google AdSense uses cookies and similar technologies to serve ads based on your visits to this and other websites. AdSense may personalize the ads you see based on non-personal data (since we do not provide personal data to it) such as the content of our pages or general location information.

AdSense and its partners may also use cookies to measure ad performance, provide aggregated statistics, or enable other advertising features. Google may share information about your use of our site (such as the fact that you visited or interacted with certain content) with its advertising and analytics partners. No personally identifying information (like your name or email) is shared by us, and Google’s use of cookies on our site is governed by Google’s own privacy policies. You can manage how Google personalizes ads to you by visiting your Google account ad settings, and you can learn more about how to opt-out of personalized ads in the Opt-Out Options section of this policy.

11. Discord Community

Earf operates an official Discord server for community discussion, support, and engagement. Discord is a third-party communications platform. By joining and participating in the Earf Discord server (for example, via an invite link on our site), you acknowledge and agree to the following:

Data Collection & Usage (Discord): We do not separately collect or store personal information from your participation in Discord. Any personal data you share on Discord (such as messages or profile information) remains on Discord’s platform. Discord, Inc. may collect and process data about your Discord usage according to its own Privacy Policy. Within our Discord server, moderators may temporarily log information (such as user IDs or messages) when needed for moderation and enforcement of rules, but we do not export Discord data into our own systems except as necessary for moderation records.

Third-Party Platform Disclaimer: Because Discord is an external platform, your use of the Earf Discord server is also subject to Discord’s Terms of Service and Community Guidelines. Earf is not responsible for Discord’s handling of data. Any concerns about how Discord itself manages privacy should be directed to Discord’s support or viewed in their privacy documentation.

Moderation & Enforcement: We reserve the right to restrict or remove any user’s access to the Earf Discord server if they violate our community guidelines or Discord’s rules. User reports and moderation decisions may be reviewed by Earf staff to maintain a safe and respectful community environment. If you believe you were banned or disciplined in error on our Discord, you may contact us at [email protected] for review. Note that this section is primarily about community conduct; it does not involve additional data collection beyond the scope described above.

12. User Rights and Global Privacy Compliance

We respect the privacy rights of all users. Even though Earf does not collect or store personal user information (beyond the limited anonymous data described above), it’s important to us that you understand your rights under various privacy laws. If we ever engage in broader personal data collection, we will inform you and ensure full compliance with all relevant regulations. Below, we outline how we comply with key privacy frameworks and the rights these laws grant to users in different regions.

California Privacy Rights Act (CPRA)

The California Privacy Rights Act (CPRA) (which builds upon the California Consumer Privacy Act) grants California residents specific rights regarding their personal data. While Earf does not collect personal data for commercial purposes or sell any user data, we fully support these privacy rights and comply with CPRA as applicable:

  • Right to Know: California residents can inquire what categories of personal information (if any) we collect, the purposes for collection, and the categories of third parties with whom that information is shared. (In our case, we currently do not collect identifiable personal info beyond analytics data.)
  • Right to Access: You can request a copy of any personal data we hold about you. Given our current practices, typically we would not have such data beyond perhaps what is in analytics logs, but we will assist with any valid request.
  • Right to Delete: You can request deletion of your personal information that we have collected. We will honor such requests to the extent possible (and applicable) given that we generally do not store personal data. If certain data must be retained for legal reasons, we will inform you.
  • Right to Correct: If we ever hold personal information about you that is incorrect or outdated, you have the right to request that we correct it.
  • Right to Opt-Out of Sale/Sharing: The CPRA gives California residents the right to opt out of the sale or sharing of their personal information. Earf does not sell or share personal data for advertising or any monetary consideration. Therefore, we do not conduct any data practices that require an opt-out. Nonetheless, if this policy changes, we will provide a clear "Do Not Sell or Share My Personal Information" option.
  • Right to Limit Use of Sensitive Information: If we collected any sensitive personal information, California users could direct us to limit its use/disclosure. (Earf does not collect sensitive personal info.)
  • Non-Discrimination: We will never deny you our services, charge you different prices, or provide a different level of service for exercising your privacy rights.

California residents can exercise these rights or direct any questions to us at [email protected]. We will verify your identity (to protect your privacy) and respond in accordance with CPRA timelines. If you are a California resident under age 16, we reiterate that our platform should be used only with parental consent and supervision (see the Children’s Privacy section below).

General Data Protection Regulation (GDPR - European Union)

The GDPR provides robust protections for personal data of individuals in the European Union (EU) and European Economic Area (EEA). Earf is committed to complying with GDPR requirements for any users in the EU/EEA:

  • Lawful Bases for Processing: If we process any personal data of EU users, it will be on a lawful basis as defined under GDPR Article 6 – typically either with your consent, or because it is necessary for providing the service you requested (contractual necessity), or for a legitimate interest (such as improving our service) that is not overridden by your data protection rights. (Currently, the minimal data we process is based on legitimate interest for analytics, and consent for any optional features like location as described above.)
  • Data Subject Rights: Under the GDPR, you have the right to access the personal data we hold about you, to rectify (correct) any inaccuracies, to erasure (the "right to be forgotten" – delete your data), to restrict processing of your data, and to object to certain processing activities. You also have the right to data portability for data you provided to us directly (to receive a copy in a commonly-used format).
  • Right to Withdraw Consent: Where we rely on your consent to process data, you have the right to withdraw that consent at any time, and we will stop the processing in question.
  • Data Retention: We only retain personal data for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Because we currently do not actively collect personal data, this primarily applies to anonymized analytics data which may be retained in aggregate form.
  • International Transfers: If we ever transfer EU users’ personal data outside of the EU/EEA (for example, to servers or service providers in other countries, such as the United States), we will ensure appropriate safeguards are in place. This may include using European Commission-approved Standard Contractual Clauses (SCCs) or transferring data only to jurisdictions with adequate data protection laws.
  • Supervisory Authority: EU users have the right to lodge a complaint with a data protection supervisory authority in their country of residence or where an alleged infringement of GDPR occurred. We encourage you to contact us first at [email protected] so we can address your concerns directly.

EU/EEA users can contact us at [email protected] for any questions or requests related to their GDPR rights. We will respond in accordance with GDPR requirements.

Brazil’s Lei Geral de Proteção de Dados (LGPD)

Brazil’s LGPD grants Brazilian users specific rights regarding their personal data and imposes obligations on how organizations handle that data. Earf complies with the LGPD as follows:

  • Legal Basis and Consent: Any personal data we process of Brazilian users will be handled on a permitted legal basis under LGPD (for example, with user consent or to meet legitimate interests). In practice, since we do not gather personal data, this mainly means that if any data processing occurs (like analytics), it is done in a lawful way and likely under a legitimate interest basis.
  • Rights of Data Subjects: Brazilian users have the right to confirm whether we process their personal data and to access that data. You also have the right to correct incomplete, inaccurate, or outdated information, and to request anonymization, blocking, or deletion of unnecessary or excessive data or data processed in violation of the law.
  • Data Portability: You may request a copy of the personal data you have provided to us in a portable format (this would apply if we had any such data; currently, we hold no personal info about users).
  • Right to Withdraw Consent: If we rely on your consent for any data processing, you can withdraw that consent at any time. For example, if you consent to share precise location for a feature, you can later withdraw that consent by disabling the feature or contacting us.
  • Information on Data Sharing: You have the right to know which public or private entities we share your personal data with. (As noted, we do not share personal data except with service providers like Google under strict conditions, and those are detailed in this policy.)
  • International Data Transfers: If personal data is transferred outside of Brazil, we will ensure it’s done in compliance with LGPD’s requirements, such as by using appropriate safeguards or only transferring to countries with adequate data protection standards.
  • Enforcement and Contacts: Brazilian users can exercise their LGPD rights by contacting us at [email protected]. We will provide a response in accordance with the timelines and procedures defined by LGPD. If you believe we have violated LGPD, you have the right to contact the Brazilian data protection authority (ANPD), but we encourage you to reach out to us first so we can address your concerns.

Australian Privacy Act 1988 & Australian Privacy Principles (APPs)

Earf is based in Australia and is committed to full compliance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs). Although we currently do not collect personal information beyond non-identifiable analytics, we ensure that any handling of personal information is done in accordance with Australian law:

  • Transparency and Anonymity: We manage personal information in an open and transparent way (APP 1). Our practices are clearly outlined in this Privacy Policy. Wherever lawful and practicable, you have the option of not identifying yourself when interacting with us (APP 2). In fact, Earf does not require user registration, so you generally remain anonymous on our site.
  • Collection and Use: We will only collect personal information if it is reasonably necessary for our functions or activities, and we will do so by lawful and fair means (APP 3). As of now, we do not collect any personally identifying information. Should that change, we will only collect what is necessary and with proper notices or consent.
  • Access and Correction: You have the right to request access to any personal information we might hold about you and to request corrections to ensure that information is accurate, up-to-date, and complete (APP 12 & 13). If in the future we hold any of your personal data, you can contact us to access or correct it. We will respond within a reasonable time and may ask to verify your identity.
  • Overseas Transfers: If we disclose personal information to an overseas recipient (for example, using a server or service provider outside Australia), we will take reasonable steps to ensure that the recipient does not breach the APPs in relation to that information (APP 8). This means we will only transfer data abroad if, for instance, the recipient is subject to similar privacy laws or we have contractual arrangements to protect your information, or we obtain your consent where required.
  • Security of Personal Information: Although we do not store personal data, we take reasonable steps to protect any information we hold from misuse, interference, and loss, as well as unauthorized access, modification, or disclosure (APP 11). Any personal information that is no longer needed will be de-identified or destroyed in accordance with the law.
  • Complaints and Enquiries: If you are in Australia and have a question or a complaint about our handling of your personal information, you can contact us at [email protected]. We will acknowledge your complaint and endeavor to respond and resolve it quickly. If you are not satisfied with our response, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC), which is the regulator responsible for privacy law in Australia.

International Data Transfers

Whenever we transfer data internationally, we implement appropriate safeguards to protect your information. This applies to any data (even if non-personal) that may be transmitted to servers or partners in other countries. Measures may include using encryption, contractual data protection clauses, and choosing partners in jurisdictions with strong privacy laws. For example, data sent to the United States for analytics or content delivery is protected via agreements that require our partners to handle the data securely and in compliance with applicable standards (like the GDPR’s Standard Contractual Clauses or equivalent mechanisms).

13. Childrens Privacy

Our services are not intended for children under the age of 16 to use without adult supervision. We do not knowingly collect personal information from children under 16 years old. If you are under 16, you should only use Earf with the involvement and permission of a parent or guardian.

We encourage parents and guardians to be aware of and guide their children’s online activity. While Earf does not collect personal data on our end, if you are a parent or guardian and believe your child under 16 may have submitted personal information through a third-party service used on our platform, please contact us at [email protected], and we will work to address the concern promptly.

14. Opt-Out Options

Because we do not collect personal information for marketing or advertising beyond standard analytics, there are limited circumstances where you would need to "opt out" on EARF. However, for completeness:

  • Analytics: If you wish to opt out of Google Analytics tracking on our site and others, Google provides an Opt-Out Browser Add-on. You can also disable or refuse cookies to reduce tracking (though as noted, we don’t use cookies for tracking on our site directly).
  • Targeted Advertising: If our site displays Google AdSense ads or similar, those ads may be personalized by Google and its partners using cookies. You can opt out of personalized advertising from many ad networks. For instance, you can visit the Network Advertising Initiative’s opt-out page or Google’s Ad Settings to adjust your preferences.
  • Do Not Track: Our site honors browser "Do Not Track" signals to the extent possible. Since we already do not profile users, a Do Not Track signal will simply reinforce that we continue not to do any personal tracking.

Remember, since we don't hold personal data, there is no need for an opt-out to prevent sale of data or similar; we simply do not engage in those practices.

15. FAFO™ Developer Tools Monitoring

To protect the security and integrity of our platform, Earf employs an automated monitoring system known as FAFO. This system detects suspicious activity in browser developer tools, such as opening or prolonged use of the console or inspection tools, attempts to tamper with site code, repeated DevTools access, suspicious scripts, use of proxies or VPNs, and other behaviors indicative of abuse or unauthorized access.

If such activity is detected, FAFO will temporarily restrict ("soft block") your access to the site. This restriction is enforced automatically and is intended solely to prevent unauthorized access or tampering.

When triggered, FAFO logs technical data including your public IP address, device fingerprint, browser and device details, user agent, referrer, timestamps, how long you were on the page, and a brief description of the detected behavior. Additional information such as navigation actions, suspicious input, and script injection attempts may also be recorded. This information is used exclusively for security monitoring, including the detection of repeat offenders, and is not used for profiling or marketing purposes.

FAFO does not collect personal information beyond what is necessary for security, and does not take visible action beyond restricting access and displaying an "Access Denied" message, or fully locking you out if you behave in manners that are deemed unacceptable or violate our policies. If you do not access or interact with browser developer tools, FAFO will not affect your experience.

There are two types of restrictions that may be imposed: a temporary "soft block" and a full "blocked" status. A soft block is a temporary restriction that may be lifted after a set period. If you trigger FAFO three times, you will be soft blocked. If you are fully blocked, your access to the platform is revoked and you will be unable to use any EARF services. When banned, you will be shown an "Access Denied" page. Any attempts to bypass or circumvent this ban will immediately trigger security alerts and may result in further legal action, criminal investigation, and notification to relevant authorities. If you believe you have been blocked in error, you may contact [email protected] to appeal your status. However, permanent blocks are typically the result of serious or repeated violations of our Terms of Service, Disclaimer, Privacy Policy, or other applicable policies, and are rarely reversed.

Every FAFO trigger will alert the EARF Security Department and may result in a review of your activity. Multiple triggers increase the likelihood of further investigation and enforcement action.

Repeated or severe violations, attempts to bypass or tamper with FAFO protections, or any activity deemed malicious may result in permanent exclusion from all EARF services, legal action, and/or disclosure of incident details to third parties for investigation or enforcement purposes. EARF may cooperate with law enforcement, regulatory bodies, or ISPs as required by law or to protect the security and integrity of the platform and its users.

If your actions are suspected to involve cybercrime, hacking, unauthorized access, or other illegal activity, EARF will report the incident to the appropriate national or international law enforcement and cybercrime authorities, as required by law and jurisdiction. 16. AI & Automated Features (GAIA)

When you interact with our AI-powered features, such as the GAIA assistant, the text of your queries and interactions is processed to generate relevant responses.

  • Data Processing: Your inputs are sent to our AI inference providers for processing. We do not use your personal conversations to train public AI models, nor do we sell this interaction data.
  • No Sensitive Data: You should not share sensitive personal information (such as health data, financial details, or passwords) when interacting with GAIA or other AI tools.
  • Retention: We may temporarily log these interactions for debugging, abuse detection, and quality assurance purposes, but they are not permanently linked to a user profile for advertising purposes.

If you use our reporting tools to flag Points of Interest (POIs), map errors, or stream issues:
